Update on BVerfG cases allocated to Justice Huber, the UPC case rapporteur

The German Federal Constitutional Court (Bundesverfassungsgericht, BVerfG) has announced here that its Second Senate will hand down its decision in the “ECB bond purchase program” case on 24 March 2020. This case is one of those allocated to rapporteur Justice Huber, who is also the rapporteur in the complaint against the Unified Patent Court (UPC) legislation. Both cases were included In the list of cases the BVerfG intended to decide in 2019, although of the eight cases allocated to Justice Huber only one was actually decided in 2019. (Each year many cases listed are not decided and simply carried over to the following year’s list.) The BVerfG has not yet published its 2020 list of cases but, as reported here, Justice Huber said in November that he intended to issue the decision “early next year”, although the timing would depend on the time it takes for him and the other judges to deliberate on and amend the judgment (there being a need for them to consider in detail its formulation and wording).
