Update on UK legislation implementing the UPC system

22.12.2014

During 2014 the UK Government has passed primary legislation authorising ratification of the UPC Agreement and also consulted on draft secondary legislation in the form of a Statutory Instrument (SI) to give effect to the UPC Agreement and EU legislation on the unitary patent.  It had been aiming also to put the SI before Parliament this side of the general election in May 2015.  It is now clear that timetable was too ambitious and the SI  will not be passed until after the election.  However, this delay should not affect the overall timetable, and the UK should still be in a position to ratify the UPC Agreement by the end of 2015, with deposit of the instrument of ratification being held back to a later date when all practical aspects of preparation for the UPC have been completed.
