On 26 June 2023, the Unified Patent Court (UPC) Administrative Committee unanimously agreed that Milan will host the third Central Division seat. In a press release from the Italian Ministry of Foreign Affairs, the Italian Government is already working to make the Milan Section fully operational by June 2024 being within the timeframe envisaged by the UPC Agreement (within 12 months under Art. 87.3). As we have reported previously, the Milan seat of the central division will be competent for IPC Section A patents (human necessities) with the Munich section being competent for IPC Section C patents (chemistry and metallurgy) and the Paris seat for IPC Sections B (performing operations, transport), D (textiles, paper), E (fixed constructions), G (physics) and H (electricity) as well as supplementary protection certificates (SPCs) based on patents from Sections A and C.
