UPC Registrar cannot advise on opt-out requirements

The Unified Patent Court (UPC) has published this news item to clarify that the Registrar cannot give any legal advice on, or interpretation of, the UPC Agreement and the Rules of Procedure. This clarification follows the Registrar having received questions on some of the guidance in the previous news item and in the FAQs. As we reported, the UPC’s previous news item included some points to note for those applying to opt out patents. The Registrar now makes it clear that an applicant must make their own assessment of the requirements of an opt-out as prescribed in Rule 5 and complete the application accordingly.
