UPC expected to open in early 2023

A report of the meeting of the Administrative Committee of the Unified Patent Court (UPC) held last Friday has been published here.  Following the steps taken in that meeting, “the timing of the start of operations of the Court can reasonably be expected to occur in early 2023.”  One key action was the adoption of the Court’s Rules of Procedure and its Table of Fees, and these enter into force on 1 September 2022 (the Rules being published during the summer after legal scrubbing). Another key step was the progress on the appointment of judges, the Advisory Committee’s Chair presenting to the Administrative Committee its list of the most suitable candidates, and this list is said to be expected to be adopted soon. Other actions included adoption of the Organisational Rules of the UPC’s Patent Mediation and Arbitration Centre, which will have seats in Ljubljana and Lisbon. The Committee also confirmed the locations of the local and regional divisions of the Court of First Instance.
