Following the latest update to the beta CMS (reported here), there is a new entry in the applications list, namely the “Application for registration as a Representative before the UPC – Article 48 of the Agreement on a Unified Patent Court”. This allows persons to apply to be entered on the Register as an “Article 48 Representative” provided you can evidence your entitlement. The possible entitlements are specified, and include the various routes under the draft European Patent Litigation Certificate Rules, in particular the ability for patent attorneys to qualify based on a having “other qualifications” under draft EPLC Rule 12. The procedure involves (in all cases) uploading a relevant certificate to evidence entitlement and a check by an individual at the Registry to confirm it.
