Following yesterday’s significant announcement here that the UK has ratified the Unified Patent Court Agreement (UPCA) and the Protocol on Privileges and Immunities (PPI), the website of the Council of the European Union now indicates that the instrument of ratification and the PPI have indeed both been deposited with the General Secretariat of the Council – see here and here.

On 27 April 2018, the UPC Preparatory Committee also posted a Ratification Update here acknowledging the UK’s announcement and summarising other recent ratifications of the PPI and the UPC Agreement. The Committee acknowledged that there were further steps before the Provisional Application Phase could begin and furtherance of the project would be dependent on the outcome of the court proceedings in Germany. Further updates will be added to the UPC Preparatory Committee website as and when progress is made.
