Portugal ratifies the Unified Patent Court Agreement

07.08.2015

Confirmation of Portugal’s ratification of the UPC Agreement was published on 6 August 2015 in the country’s Official Gazette of legislation. In the Diário da República Eletrónico, the Decree of the President of the Republic No. 90/2015 indicated that Aníbal Cavaco Silva had approved the UPC Agreement on 30 July 2015 following Parliament’s approval (No 108/2015) on 10 April 2015; a certified copy of the original UPC Agreement was also published in English and Portuguese. See here.

This brings the number of countries which have ratified the UPC Agreement to eight: Austria, Belgium, Denmark, France, Luxembourg, Malta, Portugal and Sweden. The next step is for Portugal to deposit its instrument of ratification with the Council of the European Union.

For the UPC Agreement to come into force, thirteen member states (including France, Germany and UK) must ratify and deposit their instrument of ratification in Brussels.
