The Preparatory Committee of the Unified Patent Court (UPC) has today published a message from its Chairman, Alexander Ramsay. After reporting on recent progress in several countries towards ratifying the UPC Agreement and participating in its Protocol on Provisional Application, Mr Ramsay refers to the pause in the German process due to the complaint lodged in the Constitutional Court (reported here). Mr Ramsay notes that there is little information published on the complaint and it has not been notified to the German government or parliament. However, he says that he is hopeful that the issue will be resolved quickly and the provisional application phase can start this autumn, with the sunrise period (allowing registration of opt-outs) starting early 2018, followed by the Court becoming operational.
