Belgian parliament adopts legislation to implement UPC Agreement provisions into national law

On 14 December 2017, the Belgian Chamber of Representatives (the lower chamber of the Belgian Federal Parliament) adopted draft legislation introducing amendments to Title I of Book XI of the Code of Economic Law aimed at harmonising Belgian legislation on patents with the provisions of the UPC Agreement where relevant, dealing primarily with exemptions from patent infringement.  As reported here, the bill had been submitted by the government on 6 November, and unanimously approved by the Chamber’s Committee on Economic Affairs on 29 November 2017.  The ‘Law amending various patent provisions in relation to the implementation of the unitary patent and the unified patent jurisdiction’ was adopted under the unicameral legislative procedure, and submitted on 14 December 2017 for the King’s sanction and subsequent promulgation in the Moniteur Belge.
